1. Acceptance of Terms
By engaging LTH Lathrop Concrete for services, you agree to these terms of service. Please read them carefully before proceeding with any project. If you do not agree with these terms, please do not use our services. These terms apply to all clients, whether residential or commercial, and govern our working relationship throughout your project.
2. Services Provided
LTH Lathrop Concrete provides professional concrete services including but not limited to:
- Concrete driveways and parking areas
- Concrete patios and outdoor living spaces
- Foundation and slab work
- Stamped and decorative concrete
- Concrete repair and replacement
- Sidewalks, walkways, and flatwork
- Commercial concrete installations
- Retaining walls and masonry work
Specific services for your project will be detailed in your written estimate and contract.
3. Estimates and Pricing
We provide free written estimates for all projects. Estimates are valid for 30 days from the date of issue. Prices are based on site conditions observed during the initial assessment. If we encounter unexpected conditions such as poor soil, underground utilities, or other issues not visible during the estimate, we will notify you immediately and discuss any necessary changes to the scope or price before proceeding. All prices include labor, materials, and equipment unless otherwise specified in writing.
4. Payment Terms
Payment terms will be specified in your contract. Typically, we require a deposit to schedule your project and secure materials. The remaining balance is due upon completion of the work to your satisfaction. We accept cash, checks, and major credit cards. Late payments may be subject to interest charges as permitted by California law. We reserve the right to place a mechanics lien on your property for unpaid balances.
5. Project Timeline
We provide estimated project timelines based on typical conditions. Actual completion times may vary due to weather, material availability, or unforeseen site conditions. We will keep you informed of any delays and work diligently to complete your project as quickly as possible without compromising quality. Concrete curing requires specific time periods that cannot be rushed. We will advise you on when you can use your new concrete surfaces.
6. Warranty
We warrant our workmanship and materials against defects for the period specified in your contract. This warranty covers issues resulting from faulty installation or materials. It does not cover damage from improper use, lack of maintenance, settling of the ground, acts of nature, or modifications made by others. To make a warranty claim, notify us in writing with photos of the issue. We will inspect the work and make necessary repairs at no charge if the issue is covered under warranty.
7. Client Responsibilities
You are responsible for:
- Obtaining any required permits (unless we agree to do so in writing)
- Ensuring clear access to the work area
- Marking locations of underground utilities
- Removing or protecting landscaping and personal property near the work area
- Securing pets during work hours
- Following our instructions for curing and initial use of new concrete
8. Cancellation Policy
You may cancel your project by providing written notice. Cancellations made before we begin work will result in a refund of your deposit minus any costs already incurred for permits, materials, or site preparation. Once work begins, you are responsible for payment for all work completed and materials purchased. We reserve the right to cancel projects if site conditions are unsafe or if you fail to meet your obligations under the contract.
9. Limitation of Liability
Our liability is limited to the amount you paid for services. We are not liable for indirect, incidental, or consequential damages. We maintain appropriate insurance coverage for our work. You agree to notify us immediately of any damage to your property that you believe resulted from our work so we can investigate and address the issue promptly.
10. Dispute Resolution
If a dispute arises, we encourage you to contact us directly to resolve it. Most issues can be resolved through open communication. If we cannot reach a satisfactory resolution, you agree to attempt mediation before pursuing legal action. Any legal proceedings will be conducted in San Joaquin County, California and governed by California law.
11. Changes to Terms
We reserve the right to update these terms at any time. Changes will be posted on our website with the updated date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms. The terms in effect at the time you sign your contract will govern that specific project.
